Friendly Reminder:
Foreign employees who accumulate over 90 days of time living in China
(or 183 days for those from countries that have entered dual taxation
agreements with China) but less than a year must pay appropriate taxes
for all income earned in China.
All wages earned by foreign nationals during a “period of work in China”
are seen by the state as coming from within the country, no matter
whether the employer is domestic or foreign. Here the “period of work in
China” is defined as the total of all work days and public holidays
during which a foreign national works in China. The following is an
example situation: an American Mr. A frequently visits China to provide
technical assistance to his fully-foreign-funded company. At the end of
one year, the amount of time he has spent in China totals 186 days. All
of his salary has come from his company in America; none of it has come
from any Chinese companies. Nonetheless, Mr. A must pay full income tax
on all money earned during his “period of work in China” to the People’s
Republic of China.
Failure to pay taxes on time may lead to fines and penalties. As per the
“Tax Revenue Collection Law” of the PRC, any foreign national owing
taxes to the state and their legal representatives will be prevented
from leaving China until all owed taxes are paid in full.
